Bio
Mark K. Thompson has been practicing business law and litigation since 1999. His business litigation experience is broad and in addition he has extensive appellate experience in civil and criminal matters. Mark founded his law firm, MKT Law, PLC, in 2012. At MKT Law, PLC, Mark is focused on representing small and medium-sized businesses in litigation. The types of businesses MKT Law, PLC represents include those ran by professionals (law firms, lawyers, architects, doctors, engineers, professors) in the construction industry (general contractors and sub-contractors performing structural, finishing, installing, surfacing, excavating, etc.) real estate (developers, agents, brokers) financial services (brokers, agents, bankers), health care providers, wholesalers and the service industry (retail, auto repair, restaurants and bars). Mark has represented individuals involved with these business at all levels from CEO, other officers/directors, management, representatives, independent contractors and employees.
Some recent lawsuits MKT Law, PLC has been counsel on have involved claims of breach of contract, fraud, misrepresentation, fraudulent transfers, shareholder disputes, tortious interference with contract and economic advantage, defamation, to name a few. Mark also provides non-litigation/transactional services to businesses in a number of areas, including business formation, sales and acquisitions, start-up advice, contract drafting and negotiations, commercial leasing and collections, buy-sell agreements and other corporate governance matters.
Mark is a proactive, creative and strategic litigator. In 2005, 2006, 2007 & 2008, he was named a "Rising Star" by Minnesota Law & Politics, Twin Cities Business Monthly and Mpls. St. Paul Magazine. Mark has extensive experience in complex (and not so complex) commercial cases before state and federal courts and in arbitrations. He is adept in handling your case from start through trial and up on appeal is necessary. He is also extremely skilled in settlement negotiations and client advisement and counseling. Recently, Mark was victorious in convincing the Minnesota Court of Appeals to fully reverse a trial court award of about $500,000.00 in a farm property lease dispute involving an option-to-purchase.
Prior to forming MKT Law, PLC, Mark was a business litigation attorney at a leading law firm in Saint Paul, Minnesota, where he was responsible for representing a broad range of clients with shareholder disputes, contract claims, trade secret/intellectual property misappropriations, employment disputes, construction claims, enforcing creditors’ rights/remedies, as well as numerous other areas of law.
Mark also has been an Adjunct Professor at the University of Minnesota School of Law since 2007. He teaches advanced appellate advocacy for the school’s Civil Rights Moot Court, instructing law students on how to properly research and draft appellate briefs and prepare for and deliver effective oral arguments. In this role, Mark also coaches third-year law students in an annual national moot court competition.
Mark was a member of the US District Court—District of Minnesota’s Attorney Advisory Committee, advising the court on its implementation of electronic filing. He has been published in the Hamline Law Review: Has Isaacs v. American Iron & Steel Altered the Pleading, Policy And Purpose Supporting Shareholder Dispute Claims Under Section 302A.467, 28 Hamline L. Rev. 479 (2005). Mark regularly speaks at continuing legal education seminars on ethics, debt collection techniques and emerging developments in the law.
